The US Dept of Labor has announced an increase in OSHA’s civil penalty amounts based on cost-of-living adjustments for 2021. The increased penalty levels apply to any penalties assessed after January 15, 2021.

The new adjusted maximum penalty amounts are:

  • Serious and Other-than-Serious: $13,653 per violation (an increase from $13,494)
  • Failure to Abate: $13,653 per day beyond the abatement date (an increase from $13,494)
  • Willful or Repeated: $136,532 per violation (an increase from $134,937)

States that operate their own Occupational Safety and Health Plans are required to adopt maximum penalty levels that are at least as effective as Federal OSHA’s.
